By accessing or using My Golf Insights (the "App" or "Service"), registering for an access code, or visiting mygolfinsights.com (the "Website"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not access or use the Service.
These Terms apply to the Website, the Progressive Web App (PWA), the access code registration system, and all related features and services provided by My Golf Insights ("we", "us", or "our").
My Golf Insights is a golf scoring, statistics, and coaching tool that helps golfers record rounds, track performance data, and receive pattern-based insights. The Service is designed for personal, recreational use.
The App is not a substitute for professional golf instruction. Coaching reports and suggestions are generated from your own statistical patterns. They are informational only and do not constitute advice from a qualified golf coach or PGA/PGA Tour professional. For personalised coaching, consult a certified golf instructor.
Access to the App requires a personal access code obtained through the registration process at mygolfinsights.com/get-access. By registering, you:
Your access code is personal and non-transferable. You must not share, sell, or distribute your access code to others. We reserve the right to revoke an access code if we determine it is being misused or shared.
If you lose your access code, you may re-register with the same email address to retrieve it.
You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly provide services to children under 13.
You agree to use My Golf Insights only for its intended purpose. You must not:
All golf data you enter — rounds, scores, hole details, courses, notes, and preferences — is stored locally on your device using browser storage (IndexedDB and localStorage). This data does not leave your device unless you explicitly export it using the CSV export feature.
We do not claim ownership of your golf data. However, you are solely responsible for maintaining backups of your data. If you lose your device, clear your browser storage, uninstall the App, or reset your phone, locally stored data cannot be recovered by us. We strongly recommend using the in-app backup feature regularly.
When you register for an access code, we collect and store your name, email address, the timestamp of your agreement to these Terms, and your activation history. See our Privacy Policy for full details on how this data is stored, used, and retained.
All content, design, code, branding, text, graphics, and features of My Golf Insights are owned by or licensed to us and are protected by United States and international intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Service without our prior written permission.
The My Golf Insights name, logo, and associated marks are our property. Nothing in these Terms grants you any right to use our trademarks or branding.
The Service relies on third-party services including Cloudflare (hosting and infrastructure), Loops.so (email communications), and OpenStreetMap (course data). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.
Certain features may in future require a paid subscription. When paid plans are introduced, the applicable fees, billing terms, and refund policy will be clearly disclosed before purchase. We will notify registered users of the introduction of paid plans by email with reasonable advance notice.
We reserve the right to modify pricing with reasonable prior notice. Existing paid subscribers will be given at least 30 days' notice before any price increase takes effect.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
We do not warrant that the Service will be error-free, uninterrupted, secure, or free of viruses or other harmful components. We do not warrant that coaching insights, handicap calculations, or statistical analyses will be accurate or will improve your golf scores. Golf is a complex sport and individual results vary.
We are not responsible for any decisions made, actions taken, or outcomes arising from your use of or reliance on information provided by the Service.
TO THE FULLEST EXTENT PERMITTED BY LAW, MY GOLF INSIGHTS AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
Our total aggregate liability to you for any claim arising out of or in connection with the Service, regardless of the form of action, shall not exceed the greater of: (a) the total amount you have paid us in the twelve months preceding the claim, or (b) AUD $10.00.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless My Golf Insights and its owners, operators, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit, store, or transmit through the Service.
We reserve the right to suspend or revoke your access code and terminate your access to the Service at any time, without notice, if we believe you have violated these Terms or are misusing the Service.
You may stop using the Service at any time. Termination does not affect data stored locally on your device, which remains under your control.
These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to conflict of law principles. You irrevocably submit to the exclusive jurisdiction of the state and federal courts located in Wisconsin for the resolution of any dispute arising out of or in connection with these Terms or the Service.
If you access the Service from outside the United States, you are responsible for compliance with local laws to the extent they apply.
Before initiating any formal legal proceeding, you agree to contact us at help@mygolfinsights.com and give us 30 days to attempt to resolve the dispute informally. Both parties agree to negotiate in good faith during this period.
To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted on an individual basis only, and not as part of a class, consolidated, or representative action. You waive any right to bring or participate in a class action lawsuit against us.
We may update these Terms from time to time as the Service evolves. When we make material changes, we will update the "Last updated" date at the top of this page and notify registered users by email with reasonable advance notice. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the Service.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and My Golf Insights with respect to the Service and supersede all prior agreements, representations, or understandings — whether written or oral — relating to the subject matter herein.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver of any provision will be effective only if in writing and signed by us.
